NJ Family Leave Expansion Takes Effect

Effective today, Friday July 17, 2026, the NJ Family and Medical Leave Act (NJFMLA) is amended to expand mandated job protection for employees working for employers with 15 or more employees, who take up to 12 weeks leave to care for themselves or a family member. The prior threshold for NJ FMLA coverage was if the employer had 30 or more employees.

The NJ Division of Civil Rights enforces NJFMLA and posted

this regarding the change.

NJFMLA leave protects the job of the employee. NJ Paid Family Leave provides paid benefits to employees who leave to care for a newborn, newly adopted child, sick family members or address sexual or domestic abuse. Paid leave is funded by an employees only, not employers, through payroll deduction. Click here for information from the NJ Department of Labor and Workforce Development on NJ Paid Family Leave.

Ruth Rauls, Esq., Saul Ewing, a well-regarded employment lawyer and EDGE Consulting collaborator, authored this post explaining the change when Governor Murphy signed the bill in January 2026.
